In case there are any concerns or misunderstandings regarding today's BOC case conference, I'd like to explain what has changed and what may change going forward....NOTHING!

There was no delay, change, or cancellation of the trial date, and neither party will have an issue with Scarsi and will proceed with trial as scheduled.

This was done out of precaution by Scarsi on his own without parties request — "The Court has identified a non-merits issue appropriate for discussion before trial and sets a status conference for March 10" — and at this point with the extent of everything that has been addressed and exposed I would think Scarsi would do his best to continue avoiding appearances of improprieties.

Stokd $NLST Minutes from today's conference are out...very interesting. Apparently, the reason for the hearing/issue is Scarsi's prior relationship with Samsung's O'melveny attorneys — Yagura & Petrocelli — haven't heard of Messers but must be same issue.

Isn't it just Netlist's luck that just when things start to swing their way, the overall market goes into a serious decline?

New short share report out after the close tomorrow. It probably won't show any covering that just happened, as the next report is for the period ending 02/28. But the NEXT one (for the period ending March 14th) will likely show any covering that might have caused this latest stock price rise.

$NLST it would only take a REAL CONCRETE NEWS to change the very long downtrend that saw prices collapse from $10 in 2021 to the very recent $0.6. This is not a game, it is a 360-degree war that involves shareholders, money, companies, patents, lawyers, politicians and judges.
After years of waiting, Netlist has managed to bring home a CONCRETE result. Obviously, this result must be transformed into reality with the trial against Samsung and Google, but we are witnessing something real and definitive, the first time in the history of this company (25 years of life) with fully monetized damages.
Be careful because we could also hypothesize the case of triple damages, but keeping our feet on the ground, I say that we shareholders could finally see the change. Soon we will see a sustainable and solid company.

If we are getting this kind of price action off of a cafc approval(which is phenominal news) what kind of action are we gonna see off the news exposure from a licence agreement for a small company with the biggest tech companies in the world.+ The settlement fees (whether in court or outta court) this will go ballistic when people start wondering who is netlist and why are they getting a multi million/hundred million dollar deal with Google/Samsung/sk Hynix etc. least to say I'm excited for the not so distant future of this company

SilviaJ $NLST Today, CAFC gave Samsung "additional time" to respond to Netlist's brief posted on 2/4/25.

This case relates to NLST's HBM patents 060 and 160. Samsung has until 4/16/25.

But NLST's brief, there are many reasoned arguments on how the board erred (the brief being 281 pages). They are mundane and none would rate as OMG reading......but below is one of the more interesting arguments.

Connecting two array dies to one TSV would eliminate Kim’s one-to-one correspondence between TSVs and memory dies; the one-to-one's main purpose -- avoiding data collisions.

The Board did not dispute that connecting multiple memory dies to each TSV would reintroduce data collisions. But the Board asserted that data collisions were not a problem because (NLST) “claims" do not recite that data collisions must be avoided.

The Board’s legal error of “discarding evidence” bearing on motivation to combine under the mistaken view that it was unclaimed—requires vacatur. Polaris, 882 F.3d at 1069

If nothing else, Netlist is looking for a remand....at the very least. That would set the stage for NLST winning the "Race to Final Judgement"

In an IPR, “the petitioner” has the burden of proving unpatentability.” 35 U.S.C. §316(e).

The patent owner has “no obligation to raise any objection” to the petition at all. Fanduel, Inc. v. Interactive Games LLC, 966 F.3d 1334, 1341-42 (Fed. Cir. 2020)

The Board thus may not accept an argument simply because the patent owner "did not challenge it". Icon Health, 849 F.3d at 1047

To overturn its own prior issuance of a patent, the agency must “‘examine the relevant data and articulate a explanation for its action" Id. at 1043

To the extent the Board chooses to “‘credit a party’s argument,’” it must explain why it accepts that argument “‘as its own analysis.’” Nuvasive, 842 F.3d at 1383.

The Board violated these requirements which requires remand.

Do not forget netlist made 50$ per unit of LRDIMM thanks the damages.

He is talking about billions, plural, $ products with this tech. This is so good, interesting he does not mention Google and rdimm (why?).

A range between 5 and 10m products with this tech should worth: 250 and 500m $ damages

In this case the boc trial is fundamental cause with a win here, netlist should ask damages before 2020. Imagine 5+ years of damages against Samsung and Google.

500k unit per year or more is possible cause this tech is like the 912, is covering a large amount of products!

We CANT say for sure the righ timing and damages but ALL is possible with good tech.

Ps: 5m LRDIMM is higher number but nothing is impossible with 2 of the biggest companies in the world

TOMKiLA $NLST Netlist has 4 lethal weapons to use against micron, google and samsung:
• 035 unappealable
• 523 won yesterday
• 314 close to hearing
• 608 won ptab recently

they are all related to the lrdimm business so we shouldn't expect huge volumes but they are lethal weapons that are worth IP licenses + real damages. (523 maybe rdimm too but we can’t say that for sure)

Nothing is guaranteed but the final verdict of the cafc + case with real damages is the final combo to collect real $ and force companies to sign license agreements.

We are witnessing a unique war that involves dozens of patents that cover hbm, ddr4/5, lrdimm, mrdimm and many others, 3 giants + the sk case that we hope will want to renew at increased figures. The verdict of the cafc appeal has really ignited the market and our optimism. It's really a great day, we hope the trial has dates soon!

Regardless if Samsung does any relevant/connected litigation would proceed based on final judgment post trial unless overturned on appeal. Nothing will be stayed meanwhile, just like the previous time.

Scarsi acknowledges in Feb27 ruling on motions (posted/linked by others) — "The Court acknowledges it likely contributed to the dispute by signaling its intent to use the jury instructions and verdict form from the second trial, which rested on the Rule 50(a) decisions made during that trial."

Another matter, it's reassuring Scarsi will try to prevent another juror bias scam, even though he denied background checks — "Instead, the Court intends to employ other proactive tools to protect against another juror bias problem that are available under Fed Rules such as administering a written voir dire questionnaire, seating a 10-person petit jury, and providing ..."

Stokd $NLST This BOC trial…lol, beyond words to describe what it has evolved into. Scarsi created this mess and he’s going to have to deal with it and keep it on the rails. It is just ridiculously convoluted and will be very messy and painful to watch till what I believe will be another trial win.

This filing tonight — JOINT TRIAL PROCEDURES STIPULATION AND DISPUTE SUBMISSION FOR RESOLUTION — is an example that will make your head spin…lol, try to look beyond the semantics and nuances, as muddy as they may make things seem. Perhaps the part in pic below is the dispute/issue Scarsi wants to address at a hearing, or it’s something else he'll decide on briefs.
