Tesla v InterDigital & Avanci [2025] EWCA Civ 193
In the latest chapter of FRAND litigation before the English courts, the Court of Appeal sets the boundaries of the courts’ jurisdiction to make FRAND declarations requested by the implementer in relation to a SEP platform (here, the Avanci 5G Platform targeting the automotive industry).
The appeal considered Fancourt J’s judgment ([2024] EWHC 1815 (Ch)) allowing Avanci’s Part 11 Application to set aside permission to serve out granted to Tesla on its ex parte application before Mellor J. We have summarised the factual background of the dispute in our previous note here.
The Court heard the appeal in December 2023. Notwithstanding the main judgment given by Arnold LJ, the majority (Phillips and Whipple LLJ) dismissed Tesla’s appeal for lack of a serious issue to be tried against each of Avanci and InterDigital alone. Notably, the majority confirmed that Tesla does not meet the requirements set out in Vestel Electronic Sanayi Vi Ticarat AS v Access Advance LLC [2021] EWCA Civ 440 in circumstances where it does not have any legally enforceable right against Avanci. Of relevance to the Court’s decision was, inter alia, the fact that Avanci does not agree or purport to fulfil any SEP owner’s ETSI obligations, which individual SEP owners remain under an obligation to satisfy by offering bilateral licences on FRAND terms. Instead, the Avanci 5G Platform is simply a commercially convenient arrangement through which SEP owners can choose to licence their SEPs in the alternative to a multitude of bilateral agreements and outside the scope of their ETSI FRAND undertaking.
The Court unanimously upheld the Judge’s decision refusing to permit the claim for FRAND declarations to be brought against InterDigital under CPR rule 19.8 as a representative of all SEP holders whose SEPs are included in the Avanci 5G Platform.
Tesla was refused permission to appeal by the Court of Appeal. It is entitled to apply for permission from the Supreme Court.

(Nasdaq: IDCC), a mobile, video, and AI technology research and development company, today announced that that it has signed a new multi-year, worldwide, non-exclusive, royalty bearing license agreement with a major Chinese smartphone vendor and has raised its outlook for first quarter 2025.
“We continue to execute according to our growth strategy and added a major Chinese smartphone vendor as a new customer. We now have seven of the ten largest smartphone vendors and almost 80% of the entire global smartphone market under license,” commented CEO Liren Chen. “As a result, we have increased our outlook for the first quarter. Our revised first quarter outlook includes an increase of annualized recurring revenue (ARR)1 by $40 million to approximately $500 million. This new agreement is a further demonstration of the value of our technology and the increasing momentum of our business.”

Martino Freda
Martino Freda, a Principal Engineer based in InterDigital’s Montreal Wireless Lab, has led wireless research initiatives, contributed to standards, and developed a strong portfolio of innovation enhancing the performance of radio access networks and communication efficiency to significantly improve smartphone interactions, capabilities, and services.
Martino’s early interest in math, signal processing, and finding solutions to big challenges influenced his career trajectory towards future-looking wireless innovation and standards contributions. Since joining InterDigital in 2006, Martino’s patented innovations contribute to improving device-to-device communications and relay protocols, which empowers more reliable connections, smarter IoT interactions, and greater potential for low latency XR experiences and video services. Currently serving as a RAN2 delegate, Martino is well respected throughout 3GPP and has led contributions to several technical specifications for 4G and 5G and exploratory research for 6G.
Philippe Bordes
Philippe Bordes, a Principal Scientist based in InterDigital’s Rennes Video Lab, has shaped next generation video capabilities through his innovative contributions to video compression, including the High Efficiency Video Codec (HEVC) and Versatile Video Codec (VVC), and his advocacy for their specifications in MPEG and JVET standards. Throughout his more than 30-year career, Philippe’s research and innovation advanced and achieved greater efficiencies through video codecs. His innovations also include fundamental inventions around reference picture rescaling that transcends codec evolution and enables devices to dynamically scale video based on available bandwidth.
