DAC Technologies Files Lawsuit in Pursuit of Collection of
$1,650,000 Judgment Against Former Manufacturer LITTLE ROCK, Ark.,
Nov. 25 /PRNewswire-FirstCall/ -- DAC Technologies (BULLETIN BOARD:
DAAT) today announced that it has filed suit in the Circuit Court
of Pulaski County, Arkansas against Uni-Tat International,
Uni-Champion Ltd., and Victor Lee and Arthur Yung, personally. The
Company had previously sued its former manufacturers, Skit
International, Ltd. and Uni-Skit Technologies, Inc. for breach of
the same manufacturing contract. The suit states that the
defendants had overcharged the Company for products they
manufactured for the Company, in violation of the terms of the
manufacturing contract. On August 13, 2003, in the Circuit Court of
Pulaski County, Arkansas, a twelve-member jury awarded DAC damages
in the amount of $1,650,000, including the return to the Company of
165,000 shares of DAC common stock previously issued to Skit
International. The Court, in an order issued November 10, 2003,
placed a value of $125,580 on the stock, thereby reducing the
monetary award to $1,524,420, and directed the Company's transfer
agent to cancel the shares issued to Skit International and
transfer them to the Company. On August 18, 2003, the Judge in the
Circuit Court of Pulaski County, Arkansas issued an order of
dismissal without prejudice against Uni-Tat, Uni-Champion and
Victor Lee and Arthur Yung. Defendant's attorney vigorously opposed
this order, but the Judge ruled in DAC Technologies favor. This
order now allows the Company to pursue collection of the judgment
against all these companies and Victor Lee and Arthur Yung
personally. These companies operate in the State of California and
the individuals are residents of the State of California. The suit
filed October 23, 2003 by the Company alleges that Uni-Tat and
Uni-Champion are successor companies to Skit and Uni-Skit. It also
alleges that Victor Lee and Arthur Yung, executed personally the
manufacturing contract that was the subject of the original lawsuit
won by the Company. In the opinion of the Company's counsel, there
is a substantial likelihood that the Court or jury will find in the
Company's favor on these issues, thereby allowing the Company to
pursue collection of the $1,524,420 judgment against all the
parties, including Victor Lee and Arthur Yung individually. David
A. Collins, Chairman and CEO stated, "We intend to vigorously
pursue, by all means available, the collection of this money. The
recent suit filed is part of the overall plan we have developed to
enable the Company to collect this judgment." About DAC: DAC
